Tricuss Technology Co., Ltd. (hereinafter referred to as Tricuss) provides various services according to these Terms of Use. When you complete the registration or start using this service, it indicates that you have read, understood, and agree to accept all the contents of these Terms of Use. If you disagree with the content of these Terms of Use, or your country or region excludes all or part of the content of these Terms of Use, you should immediately stop using this service. In addition, when you use specific features of this service, you may need to comply with the service terms or related regulations separately announced by this service based on the nature of the specific feature. These separately announced service terms or related regulations are also part of these Terms of Use. Tricuss reserves the right to modify or change the content of these Terms of Use at any time and announce them on the service website. Please pay attention to such modifications or changes at all times. If you continue to use this service after any modifications or changes, it is deemed that you have read, understood, and agree to accept such modifications or changes.

If you are a minor under the age of twenty, you should ask your parents or guardians to read, understand, and agree to all the contents of these Terms of Use and their subsequent modifications before using this service. When you use this service, it is presumed that your parents or guardians have read, understood, and agreed to accept all the contents of these Terms of Use and their subsequent modifications.

Privacy Policy

Tricuss values the protection of privacy. Regarding your member registration and other specific data, it will be protected and regulated by the "Privacy Policy" of this service. You understand and agree that when you use this service, this service can collect and use your personal data in accordance with the regulations of the "Privacy Policy".

General Terms

These Terms of Use constitute the complete agreement between you and Tricuss regarding your use of this service, replacing any prior agreements between you and Tricuss regarding this service. The interpretation and application of these Terms of Use, as well as disputes related to these Terms of Use, unless otherwise provided by law, shall be handled in accordance with the laws of the Republic of China and shall be under the jurisdiction of the Taiwan Taipei District Court. Tricuss' failure to exercise or enforce any right or provision of these Terms of Use does not constitute a waiver of such right or provision. If any provision of these Terms of Use is determined to be invalid by a court of competent jurisdiction, the parties still agree that the court should strive to make the intentions expressed in the provision effective, and the other provisions of these Terms of Use remain fully effective.

Registration Obligations and Account & Password Security

To use this service, you agree and promise the following:

  1. Provide your correct and complete personal information as prompted by the registration process of this service, and maintain and update the data to ensure it is correct, up-to-date, and complete. If you provide any wrong, false, outdated, or incomplete data, or Tricuss has reasonable grounds to suspect such information is wrong, false, outdated, or incomplete, Tricuss has the right to suspend or terminate your account and refuse your current or future use of all or any part of this service.

  2. You must choose a password and username. You are solely responsible for maintaining the confidentiality of your password and account, and you agree to take full responsibility for all activities that occur under your password or account (whether authorized by you or not). You agree to immediately notify Tricuss of any unauthorized use of your password or account or any other breach of security. You acknowledge that Tricuss is not responsible for any loss you incur for not complying with this section.

After completing the registration process for this service, you will receive a registration notice. You agree and promise the following:

  1. This account is non-transferable.

  2. You are responsible for maintaining the confidentiality of this account and password.

  3. You will immediately notify Tricuss when your account is stolen or any other security issues occur.

Member Usage Norms and Obligations

In addition to complying with the agreements of these Terms of Use, you agree to abide by relevant laws of the Republic of China, other service terms of this service, and agree not to engage in the following behaviors:

If you are a user outside the Republic of China, you agree to abide by relevant regulations of your country or region. You agree and guarantee never to use this service for illegal activities or behaviors that infringe on the rights and interests of others.

  1. Impersonating others in using this service.

  2. Infringing on the reputation, privacy, copyright, intellectual property rights, and other rights of others.

  3. Uploading, posting, or publishing any false, defamatory, insulting, threatening, offensive, violating public order and good morals, inducing criminal or other illegal text, images, or any form of files.

  4. Violating the confidentiality obligations required by law or contract.

  5. Uploading, posting, or publishing any computer trojans, viruses, or any code or data that interrupts, destroys, or limits the functionality of computer software and hardware.

  6. Engaging in the sale of firearms, drugs, banned drugs, pirated software, prohibited items, or other illegal transactions.

  7. Destroying and interfering with the data, activities, or functions provided by this service, or attempting to intrude, destroy this service system, or engage in any infringement or destructive behavior through this service.

  8. Collecting other people's email addresses and other personal data without consent.

  9. Other behaviors that Tricuss reasonably deems inappropriate.

If you violate the above matters or there is a risk of violation, Tricuss has the right to terminate or restrict your use of the account (or any part thereof) or this service at any time, with or without notice, and remove and delete any related "member content". You agree that if the use of this service is terminated or restricted, Tricuss is not liable to you or any third party.

Contributions to This Service

If you provide any ideas, suggestions, or proposals (hereinafter referred to as "contributions") to Tricuss and feedback, you understand and agree:

  1. The contribution is not specific confidential or proprietary information and does not infringe on the reputation, privacy, copyright, intellectual property rights, and other rights of others.

  2. Tricuss has no explicit or implicit confidentiality obligation for the contribution.

  3. Tricuss may already have similar ideas or proposals that are being considered or developed.

  4. Tricuss can use (or choose not to use) the contribution in any way, on any media for public welfare or for the purpose of promoting and promoting this service.

  5. The contribution will automatically become the property of Tricuss without any liability to you. Under any circumstances, you have no right to claim any form of compensation or compensation from Tricuss.

Your Authorization to This Service

If you do not have the legal right to authorize others to use, modify, publish, distribute, reproduce, or publicly display certain information, and to sublicense the aforementioned rights to third parties, do not upload, input, or provide such information to this service without authorization. Any information you upload, input, or provide to this service, the rights are still owned by you or your authorizer; but once you upload, input, or provide any information to this service, it means you have agreed to authorize Tricuss for public welfare, business, or promotion of this service, to use, modify, publish, distribute, reproduce, or publicly display such information, and may sublicense the aforementioned rights within this scope to others. You also guarantee that the use, modification, publication, distribution, reproduction, public display, or sublicensing of the information by this service will not infringe any third party's related rights, otherwise, you should bear the damage compensation liability to Tricuss.

System Interruption or Failure

The data access technology used by this service (such as Microsoft Azure and MongoDB, etc.) may sometimes experience interruptions or failures, which may cause inconvenience in your use, data loss, errors, etc. You should take protective measures when using this service. For damages caused to users due to Tricuss's fault (except for gross negligence), the compensation is limited to the amount received from the user in the month the damage occurred.

Links to Third-Party Websites and Content Provided by Third Parties

This service may provide links to other agency websites or services (hereinafter referred to as "third parties"). Third-party websites or services are the responsibility of their respective agencies and do not belong to the control and responsibility scope of this service. Tricuss does not guarantee the effectiveness, correctness, appropriateness, and completeness of any search results or external links. You may search or link to some inappropriate or unnecessary websites or messages. In this case, this service advises you not to browse or leave such websites or messages as soon as possible. You agree that Tricuss is not liable for any damage caused to you by linking to the aforementioned websites that do not belong to this service. This service will cooperate with other agencies and third parties (hereinafter referred to as "content providers") from time to time, and they will provide various content including job vacancies, recruitment, information, business data, business information, etc., for publication by this service, and the source of the content will be indicated when published. Out of respect for the intellectual property rights of content providers, this service does not conduct substantial review or modification of the content they provide. Tricuss is not responsible for the correctness and authenticity of such content, and you should judge it for yourself. Service Changes and Notifications

You agree that Tricuss reserves the right to modify, temporarily or permanently stop providing this service (or any part thereof) at any time, without notice. If you have purchased Tricuss's service plan and have not used it up, Tricuss will handle refunds in accordance with the laws of the Republic of China. If a notification is required by law or other relevant regulations, this service may notify you by posting on this service website, email, or other current or future reasonable methods, including changes to these terms of service. However, if you violate these terms of service, access this service without authorization, or the information provided during registration is incorrect or not updated, you will not receive the aforementioned notification.

Protection of Intellectual Property Rights

The programs, software, and website content used by this service, including but not limited to: information, data, images, files, website structure, webpage design, and member content, etc., are legally owned by Tricuss or other right holders, including but not limited to patent rights, copyrights, and proprietary technologies. No one shall modify, reproduce, distribute, publish, publicly release, reverse engineer, or reverse assemble without authorization. If you want to quote or reprint the aforementioned data, except as expressly permitted by law, you must obtain the written consent of Tricuss or other right holders in advance according to law. If violated, you should bear the damage compensation liability.

Handling of Intellectual Property Rights or Copyright Infringement

Tricuss respects the intellectual property rights of others and also requires users of this service to respect the intellectual property rights of others. This service may suspend or terminate the accounts of users who are suspected of infringement. If you believe that your copyright or intellectual property rights have been infringed, please provide the following information to this service:

  1. Your correct information and contact details, and agree to provide this information to the reported person in the event of a dispute.

  2. Proof that you can legally represent the interests of the copyright or intellectual property rights owner.

  3. Description of your claimed infringed work or other intellectual property rights, and description of the infringed material.

  4. Your declaration based on good faith belief that the use has not been authorized by the copyright owner, its agent, or the law.

  5. Your statement of the accuracy of the information contained in your notice, understanding the responsibility of false statements.

Tricuss's Disclaimer

Whether explicitly or implicitly, Tricuss does not guarantee that this service (including this content) does not have factual or legal defects (including safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, security-related defects, errors or bugs, rights infringement, etc.). Tricuss has no obligation to eliminate such defects and provide this service again to users. Tricuss will not be liable for any damages caused to users due to this service. However, when the contract related to this service between Tricuss and the user is a consumer contract stipulated by consumer contract law, this disclaimer provision does not apply. Even in the situation stipulated in the aforementioned proviso, in the damages caused to the user due to Tricuss's fault (excluding gross negligence), Tricuss is not responsible for the damages caused by special reasons (including Tricuss or users foreseeing or possibly foreseeing the occurrence of damages).
